These Terms of Service (“Terms”) govern your access to and use of www.duskandrelic.com (the “Site”) and any purchase you make from Dusk and Relic (“Dusk and Relic,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

Dusk and Relic is a direct-to-consumer brand offering high-end crystal bracelets.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from the Site. By placing an order, you confirm that you meet this requirement and that the information you provide is accurate and complete.

3. Products

We sell handcrafted and natural crystal jewelry. Because our products use natural stones, variations in color, pattern, size, and inclusions are inherent and are not defects. Product images are for illustration and may differ slightly from the item you receive.

We make no claims that crystals have healing, medical, spiritual, or therapeutic properties. Any such descriptions are provided for informational or traditional-lore purposes only and should not be treated as medical or professional advice.

4. Orders and Acceptance

Your order is an offer to buy. We accept it when we send an order confirmation and/or ship the item. We may refuse or cancel any order — for example, due to stock issues, pricing errors, or suspected fraud. If we cancel a paid order, we will refund you in full.

5. Pricing and Payment

  • Prices are shown in the currency of the country you are shopping from, where we support it, and otherwise in U.S. dollars. Prices may change without notice, and converted prices may shift with exchange rates.
  • We strive for accuracy, but if a product is listed at an incorrect price, we may cancel affected orders and refund any payment.
  • You authorize us to charge your chosen payment method for the total order amount, including taxes and shipping.
  • You are responsible for any applicable duties, import taxes, or customs fees on international orders unless stated otherwise at checkout.

6. Shipping and Delivery

We ship to the destinations listed at checkout. Delivery estimates are not guaranteed. Risk of loss passes to you upon delivery to the carrier, unless the law of your country provides otherwise (for consumers in the EEA/UK, risk generally passes on delivery to you). 7. Returns and Refunds

Returns and refunds are governed by our Refund Policy, which forms part of these Terms. Nothing in these Terms affects your statutory rights, including the EU/UK consumer right to cancel certain distance-purchase orders.

8. Intellectual Property

All content on the Site — including text, images, logos, designs, product photography, and the “Dusk and Relic” name and marks — is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

9. Acceptable Use

You agree not to:

  • Use the Site for any unlawful, fraudulent, or harmful purpose.
  • Interfere with or disrupt the Site’s operation or security.
  • Attempt to gain unauthorized access to any systems or data.
  • Scrape, harvest, or resell content or products without authorization.

10. User Content

If you submit reviews, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with our business and marketing. You are responsible for ensuring your content is lawful and does not infringe others’ rights.

11. Disclaimers

The Site and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties not expressly stated, including implied warranties of merchantability and fitness for a particular purpose. This does not exclude or limit any statutory rights that cannot be excluded under applicable consumer law.

12. Limitation of Liability

To the fullest extent permitted by law, Dusk and Relic will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data, arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law.

13. Indemnity

You agree to indemnify and hold harmless Dusk and Relic and its officers, employees, and partners from any claims, losses, or expenses arising out of your breach of these Terms or misuse of the Site, to the extent permitted by law.

14. Governing Law and Disputes

  • For customers in the United States: these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Los Angeles County, California.
  • For consumers in the EEA or UK: these Terms are governed by the laws of your country of residence, and you may bring claims in your local courts. Nothing here deprives you of mandatory consumer protections available under local law.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a new “Last updated” date and applies to orders placed after that date.
